Terms and Conditions
Pineda-Garcia Bookkeeping LLC
Effective Date: September 18, 2026
1. Acceptance of Terms
Welcome to www.pineda-garciabookkeeping.com (the "Site"), operated by Pineda-Garcia Bookkeeping LLC ("Company," "we," "us," or "our"). By accessing or using the Site, booking a consultation, or engaging our services, you ("you," "client," or "user") agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use the Site or our services.
These Terms should be read together with our Privacy Policy, which explains how we collect and use your information.
2. Description of Services
Pineda-Garcia Bookkeeping LLC provides bookkeeping services, including but not limited to transaction categorization, bank and credit card reconciliation, financial statement preparation, and QuickBooks Online setup and maintenance ("Services").
Our Services are limited to bookkeeping. We do not provide tax preparation, tax filing, legal advice, financial planning, investment advice, or certified public accounting services. Nothing on this Site, in our communications, or in our deliverables should be construed as tax, legal, or financial advice. You should consult a licensed CPA, tax preparer, attorney, or financial advisor for guidance in those areas.
3. No Professional Relationship Until Engagement
Browsing this Site, submitting a contact form, or booking a free consultation does not, by itself, create a client relationship or any obligation on our part to provide Services. A formal client relationship begins only upon execution of a signed engagement letter or service agreement between you and Pineda-Garcia Bookkeeping LLC, which will separately govern the scope, fees, and terms of the Services provided to you.
4. Consultations and Scheduling
Free consultations booked through this Site are provided for informational purposes to determine whether our Services are a good fit for your business. No advice given during a free consultation should be relied upon as a final recommendation, and no client relationship is formed by attending a consultation alone.
We reserve the right to reschedule or decline to provide Services to any prospective client at our discretion.
5. Client Responsibilities
If you engage our Services, you agree to:
-
Provide accurate, complete, and timely financial information, documents, and access to accounts or software needed to perform the Services
-
Review deliverables (reports, reconciliations, statements) for accuracy and promptly flag any discrepancies
-
Maintain your own copies of original source documents and records as required by applicable law
-
Use a secure method (such as our designated client portal) when transmitting sensitive information, including but not limited to Social Security numbers, bank account numbers, or payment card information
We are not responsible for errors, omissions, or delays resulting from inaccurate, incomplete, or untimely information provided by you.
6. Fees and Payment
Fees for Services will be set forth in your individual engagement letter or service agreement. Unless otherwise stated in that agreement:
-
Invoices are due upon receipt or as otherwise specified
-
Late payments may result in suspension of Services until the account is brought current
-
We reserve the right to change our fee structure with reasonable advance notice for ongoing engagements
7. Intellectual Property
All content on this Site, including text, graphics, logos, and design elements, is the property of Pineda-Garcia Bookkeeping LLC or its licensors and is protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from this content without our prior written consent.
Deliverables prepared specifically for you as part of engaged Services (your financial reports, reconciliations, and records) belong to you upon full payment, consistent with the terms of your engagement letter.
8. Third-Party Services and Links
Our Site and Services may reference or link to third-party tools and platforms, including but not limited to QuickBooks Online, Stripe, PayPal, our scheduling/booking provider, and social media platforms such as LinkedIn. We do not control and are not responsible for the content, privacy practices, terms, or availability of these third-party services. Your use of any third-party service is governed by that provider's own terms and privacy policy.
9. Disclaimer of Warranties

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICES SHALL NOT EXCEED THE TOTAL FEES PAID BY YOU FOR THE SERVICES GIVING RISE TO THE CLAIM IN THE PRECEDING THREE (3) MONTHS, UNLESS OTHERWISE SPECIFIED IN YOUR ENGAGEMENT LETTER.
11. Indemnification
You agree to indemnify and hold harmless Pineda-Garcia Bookkeeping LLC, its owners, and employees from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your breach of these Terms, your violation of any law, or your provision of inaccurate or incomplete information used in the Services.
12. Privacy
Your use of this Site is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information, including your rights under the California Consumer Privacy Act (CCPA/CPRA).

Any dispute arising under these Terms shall be resolved in the state or federal courts located in [Insert County], California, and you consent to the personal jurisdiction of such courts.
[Note for attorney review: consider whether an arbitration clause and/or class action waiver is appropriate for your business, this is a significant decision best made with counsel rather than by default.]
14. Changes to These Terms
We may update these Terms from time to time. The updated version will be posted on this page with a revised Effective Date. Continued use of the Site or Services after changes are posted constitutes acceptance of the revised Terms.
15. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
